By means of the present application, the applicants have assailed the judgment and order dated 03.08.2024 passed by Additional District and Sessions Judge/ F.T.C., Lukhimpur Kheri (in short 'trial court') in Criminal Case No. 845 of 2024 (State Vs. Kashif and Others).

By the impugned order dated 03.08.2024, the application preferred by the applicants for summoning the records based upon the statement of the witnesses of prosecution PW-1/ informant and PW-2/ victim, has been rejected. The relevant portion of the order dated 03.08.2024 reads as under:

"6. ्ቚस्तु ्ቚकरण ललगगिक अपरराधोሩ ससे बरालकोሩ करा ससंर्ቌण अधधगनियम त , 2012 कसे अन्तगिरत ससंचराधलत हहै तथरा उक गविधध एक गविशसेष गविधध हहै। इस अधधगनियम कसे अन्तगिरत अगभिययोगि करा ्ቚमतुख आधरार पपीग़በतरा / पपीग़በत करा अधधगनियम ककी धराररा -2 ( घ ) कसे अधपीनि पररभिरागषत शब्द " बरालक (Child)" ककी पररधध मम हयोनिरा हहै। मरानिनिपीय सविብኘच न्यरायरालय दराररा जरनिहैल धससंह बनिराम हररयराणरा रराज्य , AIR 2013 SC 3467, महरादसेवि बनिराम महरारराषष रराज्य , (2013) 14 SCC 637, कसे सम्मरागनित गनिणरयोሩ मम यह अगभिगनिधरा र रत गकयरा गियरा हहै गक गकसपी भिपी अपरराध कसे पपीग़በतरा ककी आयतु करा गनिधरा र ण , गकशयोर न्यराय अधधगनियम कसे ्ቚरागविधरानिोሩ कसे अन्तगिरत हपी गकयरा जरायसेगिरा। वितरमरानि मम गकसपी भिपी बरालक कसे आयतु करा गनिधरा र ण गकयसे जरानिसे कसे सम्बन्ध मम गकशयोर न्यराय ( बरालकयो ) ककी दसेखरसेख एविसं ससंर्ቌण अधधगनियम 2015 ककी धराररा 94 कसे अन्तगिरत सतुससंगित ्ቚरागविधरानि गनिम्निधलधखत हहै -

94 धराररा आयतु के गविषय मस उपधरारणरा और उसकरा अविधरारण म

(1) जहर ा बयोरर यरा सगमगत कयो इस अधधगनियम कसे गकसपी उपबसंध कसे अधपीनि ( सराቌኚय दसेनिसे कसे ्ቚययोजनि ससे गभिन ) उसकसे सम्ቌ लरायसे गियसे व्यगक ककी ्ቚतपीगत कसे आधरार पर यह स्पष हयोतरा हहै गक उक व्यगक बरालक हहै , तयो सगमगत यरा बयोरर बरालक ककी यथराससंभिवि सगनकट आयतु करा कथनि करतसे हहए ऐससे ससं्ቚसे्ቌण कयो अगभिधलधखत करसेगिरा और आयतु ककी और अगभिपतुगष ककी ्ቚगत्ቌरा गकयसे गबनिरा , यथरासस्थगत , धराररा 14 यरा धराररा 36 कसे अधपीनि जर ा च करसेगिरा ।

(2) यगद सगमगत यरा बयोरर कसे परास इस सम्बन्ध मम ससंदसेह हयोनिसे कसे यतुगक - यतुक आधरार हहै गक क्यरा उसकसे सम्ቌ लरायरा गियरा व्यगक बरालक हहै यरा निहह , तयो यथरासस्थगत , सगमगत यरा बयोरर , गनिम्निधलधखत सराቌኚय अगभि्ቚरा्቎ करकसे आयतु अविधरारण ककी ्ቚगቅኌयरा करा धजम्मरा लसेगिरा

(i) गविदरालय ससे ्ቚरा्቎ जन्म तरारपीख ्ቚमराण प्ቔ यरा ससंबसंधधत बयोरर ससे महैगटषकतुलसेशनि यरा समततुल्य ्ቚमराण प्ቔ , यगद उपलब्ध हयो और उसकसे अभिरावि मम ,

(ii) गनिगिम यरा निगिर पराधलकरा ्ቚराधधकरारपी यरा पसंचरायत दराररा गदयरा गियरा जन्म ्ቚमराण - प्ቔ ; (iii) और कसेविल उपरयोक (i) वि (ii) कसे अभिरावि मम , आयतु करा अविधरारण सगमगत यरा बयोरर कसे आदसेश पर ककी गियपी असस्थ जर ा च यरा कयोई अन्य निविपीनितम गचगकत्सपीय आयतु अविधरारण जर ा च कसे आधरार पर गकयरा जरायसेगिरा ; परन्ततु सगमगत यरा बयोरर कसे आदसेश पर ककी गिई ऐसपी आयतु अविधरारणरा जरासंच ऐससे आदसेश ककी तरारपीख ससे पन ् ह गदनि कसे भिपीतर पपूरपी ककी जरायसेगिपी।

(3) सगमगत यरा बयोरर दराररा उसकसे सम्ቌ इस ्ቚकरार लरायसे गियसे व्यगक ककी अगभिधलधखत आयतु , इस अधधगनियम कसे्ቚ ययोजनि कसे धलए उस व्यगक ककी सहपी आयतु समझपी जरायसेगिपी।

उक गविधधक दृषरासंत वि गविधधक ्ቚराविधरानि कसे अनितुसरार , आयतु कसे गविषय मम गकसपी भिपी गनिष्कषर हसेततु सविर्ቚथम आधरार सम्बसंधधत व्यगक कसे सम्बसंध मम गविदरालय ससे ्ቚरा्቎ जन्म तरारपीख ्ቚमराणप्ቔ यरा सम्बसंधधत बयोरर ससे महैगटषकतुलसेशनि यरा समततुल्य ्ቚमराणप्ቔ कसे आधरार पर हपी गकयरा जरायसेगिरा और इसकसे अभिरावि मम हपी अन्य गविकल्प गविचरारणपीय होሩगिसे। यहरासं यह महत्विपपूणर हहै गक उक ቅኌम ससंख्यरा -1 कसे सन्दभिर मम पपीग़በतरा करा स्कपूल C.B. SINGH GAUR MEMORIAL SCHOOL, SALEMPUR KONE, AIRA ROAD, LAKHIMPUR-KHERI मम क्ቌरा 10 मम ्ቚविसेश लसेनिसे सम्बसंधपी्ቚ विसेश फफॉमर , उक क्ቌरा 10 उतपीणर करनिसे कसे उपररान्त गविदरालय ससे ्ቚरा्቎ स्थरानिरान्तरण ्ቚमराणप्ቔ तथरा उक गविदरालय मम सपी०बपी०एस०सपी० बयोरर दराररा क्ቌरा 10 ककी परपी्ቌरा कसे सम्बसंध मम ्ቚरा्቎ धलस्ट ऑफ कसंगररसेट ककी ्ቚगतयरासं उपलब्ध हहै तथरा धजन्हम उक स्कपूल कसे ्ቚधरानिराचरायर पपी०रब्लपू० -9 रराकसेश गिगौ़በ कसे दराररा ्ቚमरागणत गकयरा गियरा हहै। उक समस्त अगभिलसेख महैगटषकतुलसेशनि सम्बसंधपी शहै्ቌगणक अगभिलसेख हहै और ऐसपी सस्थगत मम उक ्ቚराविधरानि कसे अन्तगिरत अपसेग्ቌत आविश्यकतरा कसे अनितुरूप हहै। उक अगभिलसेख ककी उपलब्धतरा कसे दृगषगित पपीग़በतरा कसे समस्त शहै्ቌगणक अगभिलसेखयो सगहत धलगपकगिण कयो आहहत गकयरा जरानिरा औगचत्यहपीनि हहै तथरा गविधधअनितुसरार अपसेग्ቌत भिपी निहह हहै।

7. उपयतुरक गविश्लसेषण कयो दृगषगित रखतसे हहए ऐसरा पररलग्ቌत हयोतरा हहै गक ्ቚराथቕኍगिण / अगभियतुकगिण ककी ओर ससे उक अस्पष , भरामक वि अनिगौगचत्यपपूणर ्ቚरा०प्ቔ , ्ቚकरण ककी करायरविराहपी कयो अनिराविश्यक रूप ससे लम्बसे समय तक गविलसम्बत करनिसे कसे आशय मरा्ቔ ससे हपी ्ቚस्तु गकयरा गियरा हहै। दण्र ्ቚगቅኌयरा ससंगहतरा ककी धराररा त -233 (3) कसे ्ቚराविधरानि कसे दृगषगित , यगद बचराविप्ቌ ककी ओर ससे ्ቚगतर्ቌरा मम कयोई आविसेदनि तसंगि करनिसे यरा गविलम्ब करनिसे यरा न्यराय कसे उदसेश्योሩ कयो गविफल करनिसे कसे धलयसे गकयरा गियरा हहै , तयो न्यरायरालय उससे निरामसंजपूर कर दसेगिरा। इसपी आशय करा अगभिगनिधरा र ण गविधधक दृषरासंत State v. Ram Sarup, 1989 Cr.L.J. 2444 (Del) वि Mahe Alam v. State of U.P., 2005 Cr.L.J. 4554 (All) मम मरानिनिपीय न्यरायरालय दराररा गकयरा गियरा हहै। अततः ्ቚराथቕኍगिण / अगभियतुकगिण ककी ओर ्ቚस्तु उक ्ቚरा०प्ቔ तदनितुसरार त गनिरस्त हयोनिसे ययोग्य हहै। "

The order has been challenged on the ground that before the trial court, the PW1/ informant (father of the victim) indicated the date of birth of the victim as 09.02.1990 and as such the school records related to St. John Bosco Public School, Lucknow and Ajmani International School, Lucknow are relevant documents and accordingly ought to have been summoned and the trial court in not allowing the prayer committed error of fact and law both.

Counsel for the side opposite as also learned A.G.A. for the State Sri Shukla stated the the order of the trial court is just, proper and has been passed after taking note of the Section of 94 of Juvenile Justice (Care and Protection) Act, 2015 (in short 'Act of 2015') and the fact that High School certificate of Class 10th issued by CBSE Board is on record and the same has been certified by the Principal of the school who appeared before the trial court as PW-9 and the said document can only be considered in the matter related to POCSO in view of the various pronouncements of the Hon’ble Apex Court including the judgments referred in the order impugned.

The typed copies of the statement(s) of PW-1 and PW-2 are on record. From

the statement of PW-2/ victim, it is apparent that during cross-examination by the defence she specifically stated her date of birth in the school records of St. John Bocso Public School, Lucknow is recorded as 16.07.1999 and brother was born in the year 1990.

PW-1, supported the story of the prosecution in the examination-in-chief, wherein he stated that at the time of incident the victim was 15 year old, and during cross-examination, regarding date of birth of the victim, initially he stated that the victim was born on 17.07.1999 or 2000, year is not confirmed and subsequently he stated 'I don't remember the date of birth correctly' and thereafter he stated that the victim was born in the year 1990 and indicated date of birth as 19.02.1990.

The aforesaid statements are to be considered by the trial court as any observation of this Court at this stage would prejudice the case of the parties before the trial court.

Considering the stand taken by the trial court while rejecting the application of the applicant for summoning the records of the schools as also Section 94 of the Act of 2015 and the fact that the certificate of class 10th issued CBSE Board and other relevant documents related to date of birth are already on record and have been proved by PW-9/ Principal, as appears from the impugned order, this Court, in the facts of the present case, is not inclined to interfere in the order impugned.

Accordingly, the present application is dismissed . No order as to costs.
