Heard learned counsel for the applicants, learned counsel for the opposite party No. 2, learned A.G.A. for the State-opposite party No. 1 and perused the record on Board.

It is submitted that during pendency of the criminal proceedings, both the parties have amicably settled their dispute out of the Court and inked compromise dated 30.9.2024, which has been filed before the court below. Certified copy of the compromise and affidavit are filed as Annexure Nos. 3 and 4 respectively. At present, both the parties have buried the hatchet and they have no grudge against each other. Therefore, instant application may be allowed and the criminal proceedings may be quashed on the basis of the compromise.

Learned counsel for opposite party No. 2 has nodded the submissions as advanced by the learned counsel for the applicant and admitted the factum of the compromise took place between the parties. It is next contended that in changed circumstances, opposite party No. 2 is not inclined to prosecute the present applicants and, therefore, instant application may be allowed and entire criminal proceedings may be quashed on the basis of compromise.

In this conspectus, as above, learned court concerned before whom the compromise application has been filed, as mentioned above, is directed to verify the compromise in presence of the parties, after recording their statements, and submit his verification report within a period of one month from date of appearance of the parties, who are hereby directed to appear

before the court below on 10/11.12.2024.

List this matter on 19.2.2025 along with verification report submitted by the court concerned, if any.

Till the next date of listing, further proceedings in Session Trial No. 17/2013 ( State Vs. Sevati Lal & others), arising out of Case Crime No. 603A/2010, under Sections 323, 324, 307, 504, 506, 427 I.P.C., Police Station- Saiyan, District- Agra, pending in the court of Additional District & Session Judge, Court No. 6, Agra, shall remain stayed.
