Heard learned counsel for the petitioner and learned AGA for the State as well as Shri Ajay Deep Verma, Advocate appearing on behalf of respondent no. 4 who has filed vakalatnama along with short counter affidavit which is taken on record.
Learned counsel for the petitioner submits that the petitioner and opposite party no. 4 (victim) have entered into compromise and therefore, the impugned proceedings are liable to be quashed.
Learned AGA has opposed the prayer submitting that offence is under Section 376 IPC read with Section 3/4 of POCSO Act and the victim was minor at the time of incident and therefore, she could not enter into compromise. Consent of a minor is no consent in the eyes of law.
Learned AGA prays for and is granted three days time to go through the judgments provided by the learned counsel for the petitioner.
