Sri Rakesh Kumar Mishra, learned counsel for the applicant, Sri Sunil Kumar Tiwari, learned counsel for opposite party No.2 and Sri Abhishek Kumar, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the order dated 31.7.2024 passed by Additional Sessions Judge (Court No.2), Rampur in Session Trial No.134 of 2024 (State vs. Usman Khan and others) arising out of Case Crime No.225 of 2017, under Sections 323, 436, 506 IPC, Police Station-Milak, District-Rampur, pending in the court of Additional Sessions Judge, Court No.2, Rampur.
After some arguments, learned counsel for the applicants does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction.
Certified copy of the relevant documents may be returned to the learned counsel for the applicant after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
