Sri Sarvendra Kumar Pandey, Advocate holding brief of Sri Amit Rai, learned counsel for the applicants and Sri Chavi Pal Singh, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceedings of Criminal Case No. 4048 of 2023, (State Vs. Sadakat and others) arising out of Case Crime No. 453 of 2022, under Sections 420, 406, 120-B, 504, 506 of I.P.C., Police Station- Najibabad, District- Bijnor, as well as cognizance/ summoning order dated 03.08.2023 pending in the Court of Additional Chief Judicial Magistrate, Court No. 1, Bijnor.
Learned counsel for the applicant submits that the present application has become infructuous due to allowing of the discharge application in favour of the applicants.
In view of the above, the application is dismissed as infrucutuous with the aforesaid liberty.
