Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Principal Judge, Family Court-III, Jaunpur to decide Case No. 1496 of 2020 titled Neelam v. Ram Sahai, under Section 128 Cr.P.C., P.S. Barsathi, District Jaunpur, within stipulated time.

It has been argued by the learned counsel for the applicants that application under Section 128 Cr.P.C. is pending decision before the learned Family Court since 2020 but no progress has been made so far. He further argued that the matter was listed before the learned Family Court 39 times, but no effective order has been passed.

It is unfortunate that despite series of judgments by the Supreme Court and this Court as well regarding timely disposal of maintenance application, 39 odd times the application under Section 128 Cr.P.C. is listed, and still the application has not been decided.

The instant application is disposed of with a direction to learned Additional Principal Judge, Family Court-III, Jaunpur to decide

Case No. 1496 of 2020 titled Neelam v. Ram Sahai, P.S. Criminal Case No. 1213 of 2021, under Section 128 Cr.P.C., P.S. Barsathi, District Jaunpur, expeditiously in accordance with direction of this Court issued in the case of Smt. Parul Tyagi v. Gaurav Tyagi reported in ( 2023) SCC OnLine All. 2684.
