Sri Shadul Vikram Swaroop, Advocate has sought adjournment of the case on the ground that there has been bereavement in the family of the learned counsel for the applicant. The prayer is rejected and the court proceeds to decide the application with the assistant of the learned A.G.A-I Sri Shaunak Singh.

The present application has been filed under Section 482 Cr.P.C, seeking quashing of the charge sheet no. 01/2020 dated 01.01.2020 under Section 468 I.P.C, filed in furtherance of an F.I.R. in Case Crime No. 915/2020 dated 23.11.2019 and the order dated 12.02.2020 passed by the Chief Judicial Magistrate, Raebareli, taking cognizance of the aforesaid offence and summoning the applicant to face the trial for the same.

The parties have already entered into a compromise. The applicant had previously filed an application under Section 482 Cr.P.C 11023 of 2023, which was disposed of by means of an order dated 07.11.2023 providing that the court concerned shall verify the genuineness of the compromise.

The court has verified the compromise by means of an order dated 24.11.2023 and a copy of the order dated 24.11.2023 and that of the compromise held between the parties have been annexed with the affidavit. The compromise categorically states

that the parties have entered into a settlement and there remains no dispute between them and that the informant does not want any proceedings in this case.

Accordingly, the application is allowed and the entire proceedings of the complaint case no. 1742/2020 arising out of Case Crime No. 915/2020, P.S. Kotwali Nagar, District Raebareli including the charge sheet 01/2020 dated 01.01.2020 and the summoning order dated 12.02.2020 are hereby quashed.
