Heard Shri Ajay Kumar Chaurasia, learned counsel for the applicant and Shri Madhvendra Pratap Singh, learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed with a prayer to issue a direction to the court below to release the applicant in total five cases on the basis of personal bond and two sureties, which are as follows:
(3) Case Crime No. 307 of 2021, under Section 307 IPC, P. S. Sikandra, District Agra.
(4) Case Crime No. 308 of 2021, under Section 3/25 Arms Act, P. S. Sikandra, District Agra.
(5) Case Crime No. 255 of 2022, under Section 2/3 Gangster Act, P. S. Sikandra, District Agra.
Learned counsel for the applicant submits that the applicant is not named in any case. The applicant has been implicated in the aforesaid cases on the basis of confessional statement of coaccused and his own confessional statement. It is further submitted that the applicant is languishing in jail since 27.05.2022 inspite of bail orders passed and last bail order has been passed on 09.07.2024. It is further submitted that the applicant is a poor person and social status of the applicant is not good and due to this reason he has failed to arrange the sureties in each case. It is further submitted that the father of
applicant has a constructed house.
In view of above facts and circumstances, the court concerned is/are directed to release the applicant in aforesaid total five cases on the basis of personal bond of Rs. 50,000/- and two sureties of like amount to the satisfaction of the court concerned.
With the above observations this application is disposed of.
