The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the order dated 09.02.2024 passed by Additional Sessions Judge, Court No. 1, Mirzapur in Criminal Revision No. 28 of 2023 (Deepak Kumar Singh and another vs. State of U.P.), whereby the revisional court affirmed the order dated 20.01.2023 passed by Additional Chief Judicial Magistrate-I, Mirzapur in Criminal Case No. 5853 of 2012 (State vs. Jayant Kumar Shukla and others), arising out of Case Crime No. 594 of 2012, under Sections 419, 420, 467, 468 IPC, whereby the discharge application has been dismissed.
After some arguments, learned counsel for the applicants does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction.
Certified copy of the order may be returned to the learned counsel for the applicants after retaining a xerox thereof.
In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
