This application under Section 482 Cr. P.C. has been filed by the applicants with the prayer to quash the Charge sheet No. 132 of 2022 dated 22.06.2022 and cognizance order dated 06.09.2022 as well as entire proceeding of Case No. 11603 of 2022 (State Versus Neeraj Kumar Sharma @ Meenu and others), Case Crime No. 105 of 2021, under Sections 420, 504, 506, 120-B I.P.C. Police Station Kamla Nagar, District Agra on the basis of compromise.
It is submitted by the learned counsel for the applicants that parties have entered into compromise and matter has been settled amicably between the parties. Compromise was filed before the learned trial court in pursuance to the order passed by this Court on 14.03.2024 in Criminal Misc. Application under Section 482 Cr. P.C. No. 2688 of 2024, which was got verified, certified copy of which is on record, therefore request to quash the entire proceeding of the case in terms of compromise.
Learned A.G.A. has no objection in this regard.
On considering the facts and circumstances of the case, submissions made by the learned counsel for the parties and perusal of record, compromise between the parties has been verified and is on record, it will serve no purpose in keeping the proceeding pending before the learned trial court, therefore, it is expedient and also in the interest of justice to quash the entire proceeding of the case including the charge sheet in terms of compromise.
In view of above facts, the the Charge sheet No. 132 of 2022 dated 22.06.2022 and cognizance order dated 06.09.2022 as well as entire proceeding of Case No. 11603 of 2022 (State Versus Neeraj Kumar Sharma @ Meenu and others), Case Crime No. 105 of 2021, under Sections 420, 504, 506, 120-B I.P.C. Police Station Kamla Nagar, District Agra are hereby quashed.
The application under Section 482 Cr.P.C. is allowed.
