Heard Shri Pranshu Dwivedi, learned counsel for the applicant and Shri Sandeep Choudhary, learned A.G.A. for the State.

The instant application under section 482 Cr.P.C. has been filed seeking a direction to the Civil Judge (J.D)/FTC No. 1, Agra to decide Case No. 4936 of 2023 (Aniruddha Garg and others Vs. Sunil Gupta and others) filed under section 12 of the Protection of Women from Domestic Violence, Act 2005 police station Kamla Nagar District Agra as well as the Interim Maintenance Application dated 3.7.2023 within a specified period.

At the outset, learned A.G.A. for the State submits that since the instant application is arising out of the proceedings under section 12 of the Domestic Violence Act, therefore, in view of the judgement of a Coordinate Bench of this Court dated 31.7.2024 passed in Application u/S 482 Cr.P.C. No. 6975 of 2013 (Smt. Suman Mishra vs. The State Of U.P And Ors.), wherein the Court has observed that the 482 Cr.P.C application shall not be maintainable, challenging the proceedings u/s 12 of the D.V. Act., the instant application is not maintainable.

In view thereof, learned counsel for the applicant seeks to withdraw the instant application with liberty to file appropriate petition, which may be available to him under law.

The instant application is therefore dismissed as withdrawn with the aforesaid liberty.
