Present application under Section 482, Cr.P.C. has been filed by the applicants to quash the entire proceedings of case No. 3897 of 2022 (State Vs. Ram Nath Yadav @ Kariya Yadav and others), arising out of case crime No. 488 of 2020, under Sections 323, 504, I.P.C., Police Station Baragaon, District Varanasi as well as cognizance/summoning order dated 13.1.2022, pending in the court of Additional Chief Judicial Magistrate-Vth, Varanasi.
After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction.
The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
