Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This application under Section - 482 Cr.P.C. has been preferred against order dated 07.10.2023, passed by learned Principal Judge, Family Court, Hathras, in Case No. 130 of 2017 (Smt. Rajni @ Meenakshi and another Vs. Devendra Singh), under Section - 125 Cr.P.C., Police Station - Hasayan, District - Hathras.

After arguing at some length, learned counsel for applicant submits that he is not pressing the prayer to set aside the impugned order and that the family court concerned may be directed to enable the applicant to deposit the arrears of maintenance in installments.

In view of aforesaid, it is directed that in case applicant moves an application before the family court concerned within a period of two weeks from today for paying/depositing the arrears of maintenance in installments, the same shall be considered and decided by the concerned family court expeditiously in accordance with law.

With aforesaid observations, the application under Section - 482 Cr.P.C. is disposed of.
