- Heard learned counsel for the applicants and learned AGA for the State.
- This application under Section 482 Cr.P.C. has been preferred for quashing of the entire proceedings, including summoning order dated 20.02.2024, of Complaint Case No.441 of 2023 (Ganga Ram Vs. Rajendra and others), under Sections 354, 506 IPC, Police Station- Azeemnagar, District- Rampur, pending before the Court of Additional Civil Judge (J.D.), Court No.2, Rampur.
- It has been submitted by learned counsel for the applicants that on 26.07.2023 the opposite party no.2 and his family members have assaulted the wife of applicant no.2 and in that connection she has lodged a first information report on 31.07.2023 under Sections 323, 354Kha IPC against opposite party no.2 and his family members and after investigation, charge-sheet was submitted on 27.08.2023 and thereafter impugned complaint has been lodged by the opposite party no.2 as a counterblast. The wife of opposite party no.2 has not sustained any injury. It was submitted that impugned proceedings are liable to be quashed.
