Heard learned counsel for the applicants and learned AGA for the State.

It has been argued by learned counsel for the applicants that applicants are innocent and no prima face case is made out against them. Applicants are mother-in-law, father-in-law, sister-in-law and brother-in-law of informant/victim and no specific allegations have been made against them. The dispute is between victim and her husband. It is further submitted that applicant no. 2 has filed a complaint against victim and her family members and the first information report of this case has been lodged as a counterblast to that complaint.

Considering the submissions of learned counsel for the applicants, matter requires consideration.

Learned A.G.A. has accepted notice on behalf of opposite party no. 1.

Issue notice to opposite party no. 2, returnable at an early date. Steps be taken within a week.

Counter affidavit to be filed within four weeks by the learned A.G.A. as well as by the opposite party no. 2 and rejoinder affidavit, if any, to be filed within three weeks thereafter.

List on 21.08.2024.

Till the next date of listing, no coercive action shall be taken against the applicants, namely, Smt. Guddi, Mahesh Chandra Sharma, Neha @ Gunjan and Rahul Sharma in Case No. 171/2024, arising out of case crime no. 106/2023, under Section 498A IPC and Section 3/4 of D.P. Act, P.S. Mahila Thana, district Aligarh, pending in the court of C.J. (JD),FTC, Court No. 1, Aligarh.
