Learned A.G.A. was already granted time to file counter affidavit vide order dated 20.02.2024 passed by the Coordinate Bench of this Court but till date no counter affidavit has been filed by learned A.G.A.
Learned A.G.A. for the State-opposite party No.1 submits that he may be given some time to file the counter affidavit on behalf of the State-opposite party No.1.
Learned Counsel for the applicant submits that due to unprecedented circumstances he could not take steps for service of notice upon opposite party No.2 within stipulated time, thus, he prays for some further time to take fresh steps for service of notice upon opposite party No.2.
In view of the above, learned A.G.A. for the State-opposite party No.1 is granted one week and no more further time to file counter affidavit on behalf of the State-opposite party No.1 and learned Counsel for the applicant is also granted one week's further time to take fresh steps for service of notice upon opposite party No.2.
If fresh steps are taken by learned Counsel for the applicant within stipulated time, office may proceed accordingly and if the notice is successfully served upon opposite party No.2, it may file its counter affidavit within one week thereafter.
Accordingly, list/put up this case on 29.04.2024.
Interim order, if any, shall continue till the next date of listing.
