Sri Alauddin, learned counsel for the applicant and Sri Ashwani Kumar Rai, learned A.G.A. for the State are present.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceeding of Criminal Case No. 1253 of 2020 (State vs. Kamruddin Ansari), arising out of Case Crime No. 1348 of 2018, under Sections 406, 419, 420 IPC, P.S. Khalilabad, District Sant Kabir Nagar as well as cognizance/summoning order dated 18.02.2020, pending in the court of Chief Judicial Magistrate, Sant Kabir Nagar.
After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file a appropriate application before the court of competent jurisdiction.
