5.Learned counsel for the applicant submitted that complainant has already taken recourse by filing a civil suit in regard to removal of water pipeline in the year 2018 and only in order to put more pressure, a criminal colour is given by the complainant. Aforesaid fact is like an argument in form of a double edged weapon that filing a civil suit may be a ground to commit the occurrence.

सतुनन एवनां पतनवलली परि उपलब्धि सनक्ष्य कन सम्यक पररिशलीलन दकयन।
पररिशलीलन सदे स्पष्ट हहै दक पररिवनदिली नदे धिनरिन 200 दिनां० प्र० सनां० कदे अन्त मम सशपर यह करन दकयन हहै दक घटनन ददिनननांक 16.12.18 समय 11.00 बिजदे ददिन ककी हहै। स्वनमलीननर, पवन, दबिन्दिपू व अन्य चनरि अजनत व्यदक लनठिली डण्डन
लदेकरि आयदे औरि सहन ककी भपूदम मम लगली पनइप कलो लनठिली सदे तलोड़नदे कन प्रयनस करिनदे लगदे। मनन दकयन तलो लनत घपूनांसन सदे मनरिनदे लगदे। घरि मम प्रवदेश करिकदे स्वनमलीननर व पवन नदे पत्नली चन्दिन , मतुनली, सतुधिन लकली कलो पकड़करि दगरिन ददियदे। बिहह नदे बिचनयन तलो सनड़ली खिलोल ददियन औरि जनन सदे मनरिनदे ककी धिमककी दिदेकरि चलदे गयदे।
धिनरिन- 202 दिनां०प्र०सनां० कदे अन्तगरत पररिवनदिली कदे गवनहनन नदे अपनदे सशपर बियनन मम कहन हहै दक घटनन ददिनननांक 16.12.18 समय 11.00 बिजदे ददिन मम चनरि व्यदकययों कदे सनर अजनत दिलो हनर मम लनठिली डण्डन धलयदे दशवननर ककी जमलीन परि जलो सहन कन दववनदि रन। मफौकदे परि आकरि लनत घपूनांसदे सदे दशवननर कलो मनरिनदे पलीटनदे लगदे। दशवननर कदे शलोरि मचननदे परि स्वनमलीननर व पवन कतुमनरि दिफौड़तदे हहए दशवननर कलो पकड़ धलयदे। घरि मम घतुसकरि बिनल पकड़करि मनरिनदे लगदे एवनां लनत घपूनांसन व डण्डयों सदे मनरिदे।
अततः पररिवनदि करननक, धिनरिन - 200 दिनां.प्र.सनां. धिनरिन - 202 दिनां.प्र.सनां. कदे बियननयों एवनां मनमलदे कदे समस्त तथ्ययों कदे आधिनरि परि अदभयतुक स्वनमलीननर कदे दवरूद्ध अन्तगरत धिनरिन 323, 334, 452, 506 भन.दिनां.दव तरन अदभयतुक पवन कदे दवरूद्ध अन्तगरत धिनरिन 323, 452, 506 भन०दिनां०दव० कन प् र म दृष्टयन अपरिनधि बिननन प्रतलीत हलोतन हहै। धजसकदे दवचनरिण हदेततु अदभयतुकगण आहहत दकयदे जननदे यलोग्य हहै।
