Sri Prem Kumar Srivastava, Advocate has filed vakalatnama on behalf of the opposite party no.2, which is taken on record. Office is directed to print his name in the cause list when the case is next listed.
In compliance of the order dated 11.03.2024, the opposite party no.2, Ms. Kanchana Srivastava is present before this Court in person and she has been identified by her counsel. However, the applicants are not present but their counsel Sri Shishir Pradhan, Advocate is present.
Ms. Kanchana Srivastava submits that several times mediation proceedings have been initiated but the same got failed, however, she is still ready to take one more chance.
Accordingly, the matter is being referred to the Mediation and Conciliation Centre, High Court, Lucknow. Learned counsel for the applicant will submit the copy of the present application alongwith affidavit on 30.04.2024 at the Mediation and Conciliation Centre. Both the parties shall appear there on 30.04.2024 and there is no need of issuing notice to the parties by the learned Mediator as the opposite party no.2 is present before this Court and the order is being passed in her presence. The mediator is allowed two months' time to find out possible solution of the dispute between the parties and send his report to the court regarding the outcome of mediation.
Put up this case on 22.07.2024 before appropriate Bench along with report of the mediator.
It is directed that out of Rs.30,000/- deposited by the applicants, Rs.25,000/- shall be handed over to the opposite party no.2 on her first appearance and Rs.5,000/- shall be kept by the Mediation Centre.
Interim order granted earlier shall continue till the next date of listing.
This case shall not be treated as tied up or part heard with this Bench.
