Heard Sri Mohd. Faiz, Advocate holding brief of Sri Irshad Ahmad, learned counsel for the applicants.

It is another case where the arguments are not supported by pleadings, still considering that applicants have approached this Court for invoking inherent jurisdiction, therefore, I have perused the impugned order passed under Section 204 Cr.P.C. which is bereft of reasons as required under Section 204 Cr.P.C.

Learned Magistrate has not even referred statements recorded under Section 202 Cr.P.C. as well as contents of statement recorded under Section 200 Cr.P.C. even in brief has also not been mentioned.

In aforesaid circumstances, Court also takes note of submissions of learned counsel for applicants about a civil dispute pending before parties.

पनरली/पररिवनदिली नदे अपनदे पनररनन पत मम सनांकदेप मम करन दकयन हहै दक पनरररनली / पररिवनददिनली वनददिनली ककी नननली ममु० महममूदिली बदेगम पत्नली अब्दिमुल मजलीदि खननां कन एक मकनन ममौहलन दिदेहलली दिरिवनजन सम्भल मम ससरत हहै। इनककी ममृत्यमु उपरिनन्त उक्त मकनन ककी 3/4 भनग ककी मनरलक पनररनली ककी मनतन शलीपदत हनशमली बदेगम पननली ममौहम्मदि जहहरि व 1/4 भनग ककी मनरलक पनररनली ककी ममौसली शलीमदत कनजमली पत्नली हनदमदि दन० आजमनगरि बरिदेलली हहयली। शलीमदत कनजमली ककी ममृत्यमु उपरिनन्त उनककी पमुतली जलीनत पत्नली इसरिनरि दन० आजमनगरि बरिदेलली , उनकदे 1/4 भनग ककी मनरलक हहयली। पनररनली ककी मनतन शलीमदत हनशमली बदेगम नदे ददिनननांक 25.11.2022 कको पनररनली कदे हक मम दिनन पत दनष्पनददित करि ददियन हहै। इस पकनरि उक्त मकनन मम 3/4 भनग ककी मनरलक पनररनली व 1/4 भनग ककी मनरलक जलीनत हहै। पनररनली ककी मनतन नदे उनकदे समौतदेलदे भनई नसलीम अहमदि खनखाँ पमुत अब्दिमुल मजलीदि खननां दन० ममौहलन दमयनखाँ सरिनय , सम्भल कको उनककी जरूरित कदे चलतदे रिहनदे कदे रलए दिदे ददियन रन। दकन्तमु बनदि मम नसलीम अहमदि ककी दनयत खरिनब हको गयली औरि

उन्हकोनदे हमनरिदे कई बनरि कहनदे कदे बनदि भली हमनरिन उक्त मकनन खनलली नहहीं दकयन। पनररनली कको ददिनननांक 26.11.2022 कको जननकनरिली हहयली हहै दक उक्त नसलीम अहमदि खनखाँ नदे उक्त मकनन अपनली पमुतली सनरजयन खनन कदे ननम करि ददियन हहै तब पनररनली नदे अरधिवकन सदे सब रिरजसटटनरि कनयनरलय मम जननकनरिली करिनयली तको पतन चलन दक उक्त नसलीम अहमदि खनन नदे अपनदे भनई कसलीम खननां (ममृतक) व शबननन परिवलीन पत्नली असलीरि खननां दन० ममौहलन फमूटन दिरिवनजन कनदिरिली चमौक आखाँवलन , बरिदेलली, व नसरि अहमदि खननां पमुत नसलीम अहमदि खखॉ दन . ममौहलन दमयननां सरिनय सम्भल सदे हमसनज हकोकरि एक कमूट रिदचत दिसतनवदेज दहबनननमन ददिनननांदकत 15.12.2015 अपनली पमुतली सनरजयन खनन कदे ननम पनांजलीकमृत करिन रलयन रन। इस पकनरि उपरिकोक्त ममुसलजमनन नदे पनररनली ककी मनतन हनशमली बदेगम कदे पहैतमृक मकनन ससरत ममौहलन दिदेहलली दिरिवनजन , समभल कको हड़पनदे ककी नयलीत सदे फजर्जी दहबनननमन दबनन मनरलकननन हक कदे एवनां असल तथ्ययों ककी जननकनरिली हकोनदे कदे बनदि भली सब रिरजसटटली कनयनरलय सम्भल मम बहलीसनां० 1 रजलदि सनां० 7587 कदे पमृष्ठ 75/94 कदे क्रमननांक 16396 परि ददिनननांक 15.12.2015 कको पनांजलीकमृत करिनयन हहै। समुनन तरन पतनवलल कन अवलकी कन दकयन। ो

अदभयमुक्तगण शनरजयन खनन , नसर ि अहमद ि खनन ां , शबननन पर ि वलन ी कदे दवरूद्ध धिनरिन - 420 भन०दिनां०सनां० कदे अन्तगरत पसनांजनन रलयन जनतन हहै। अदभयमुक्तगण कको जररियदे समन तलब दकयन जनयदे। पररिवनदिली आवश्यक पहैरिवली करिम। पररिवनदिली समूचली गवनहनन दिनरखल करिम। पतनवलली वनसतदे हनरजरिली ददिनननांक- 16.02.2024 कको पदेश हको।"

In aforesaid circumstances, taking note of above submissions, it is a fit case where inherent powers can be invoked since impugned order is in the teeth of judgments passed by Supreme Court in Lalankumar Singh and others vs. State of Maharashtra, 2022 SCC OnLine SC 1383 and in Delhi Race Club (1940) Ltd. & Ors. Vs. State of Uttar Pradesh & Anr, 2024 INSC 626 , that requisite reason has not been assigned that there are sufficient ground to proceed against applicants for offence under Section 420 I.P.C. therefore, impugned order dated 5.2.2024 passed by Civil Judge (Junior

Division)/Judicial Magistrate Out Court, Sambhal in Complaint No.40 of 2023 (Sabra Bi Vs.Shazia Khan & Others, under Section 420 I.P.C., Police Station-Kotwali Sambhal, District-Sambhal is set-aside and since this order is passed without issuing notice to the Opposite Party No.2 therefore, matter is remanded back to learned Trial Court to pass fresh order within a period of three months after hearing the complainant and taking note of above referred judgments in Lalankumar Singh and Delhi Race Club (supra).

With aforesaid observations/direction this application is disposed of.
