Learned counsel for the applicant submits that due to inadvertence the prayer has been wrongly mentioned.

Learned counsel for the applicant is permitted to correct the same during the course of hearing.

Sri Atmaram Nadiwal, learned counsel for the applicant, Sri Dinesh Kumar Yadav, learned counsel for the opposite party no. 2 and Sri R.K. Singh, learned A.G.A. for the State are present.

The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceedings of Criminal Case No. 742 of 2022, (Ramesh Chandra Yadav Vs. Archana and others) arising out of Case Crime No. 114 of 2015, under Sections 419, 420 of I.P.C., Police Station- Kotwali, DistrictAzamgarh, as well as cognizance/ summoning order dated 16.11.2023 pending in the Court of Judicial Magistrate, Court No. 24, Azamgarh.

After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.

Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.

In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
