Heard counsel for the applicant and learned A.G.A. for the State.
The counsel for the applicant submits that the prior to registration of the FIR No.0150 of 2024 on 23.05.2024, under Sections 354, 323, 504, 506 IPC at Police Station- Dhanepur, District- Gonda, the sister of the petitioner namely Ms. Sambhavi Dubey had registered an FIR on 23.05.2024 as FIR/ Case Crime No.0147 of 2024, under Sections 354, 323, 325 IPC at Police Station- Dhanepur, District- Gonda.
It is alleged that the petitioner, his sister and mother were given beatings by the informant's side. Thereafter, the sister of the petitioner lodged the FIR No. 0150 of 2024. As counter-blast to the same, the impugned FIR No. 150 of 2024 23.05.2024 was registered by the informant's side under Sections 354, 323, 504, 506 IPC, at Police Station- Dhanepur, District- Gonda. It is submitted that in fact, it is a version and cross version case.
Matter requires consideration.
Issue notice to private opposite party No. 2, returnable at an early date. Steps be taken within a week.
List this case on 18.03.2025.
By the next of listing, the trial court shall not frame charges against the applicant.
