This application has been filed praying inter alia the following relief:
"It is most respectfully prayed that this Hon'ble Court may kindly be pleased to stay the entire proceedings of the Session trial No. 14/2022 (State Vs. Ahmad Raza and Ors.), hereinafter referred to as 'the impugned proceedings' as well as charge sheet dated 12.05.2020 (Contained as annexure no.2), under section-3(1) U.P. Gangsters and Anti- Social Activities (Prevention) Act, 1986, arising out of case Crime No. 74/2019, Police Station -Tulsipur, District- Balrampur, and the impugned summoning order dated 19.06.2020 along with consequential Impugned Non-Bailable order dated 23.10.2024, Passed by A.S.J./F.T.C.II, Balrampur by means which Non Bailable warrant has been issued against the appellant (contained as annexure no. 1) in the interest of justice."
The counsel for the applicant submits that on the basis of single FIR, he has been implicated the under section-3(1) U.P. Gangsters and AntiSocial Activities (Prevention) Act, 1986, arising out of case Crime No. 74/2019, Police Station -Tulsipur, District- Balrampur.
Matter requires consideration.
Issue notice to opposite party No.2, returnable at an early date. Steps be taken within a week.
