Heard Sri Manjeet Singh, the learned counsel for the petitioner, Sri Ram Kumar Maurya, the learned Standing Counsel for the State and perused the records.

By means of the instant petition under Article 227 of the Constitution of India the petitioner has sought issuance of a direction to the Tehsildar, Tehsil Lalganj, District Pratapgarh for expeditious disposal of Case No.1848 of 2020: Asha Devi Vs. Chandrika Prasad, under Section 34 of U.P. Revenue Code, 2006, which is pending since the year 2020.

The perusal of the order sheet of the proceedings before the Tehsildar concerned indicates that during the period 05.09.2020 to 09.09.2024, the Tehsildar could not proceed on as many as 26 dates because the advocates were on strike. On 22 dates, the Tehsildar was engaged in administrative works.

The applications under Section 34 of U.P. Revenue Code, 2005 are required to be disposed of expeditiously within 90 days. Therefore, there is no justification for such a long pendency of the application.

Accordingly, this petition is disposed of by giving a direction

to the Tehsildar, Tehsil Lalganj, District Pratapgarh for deciding Case No.1848 of 2020: Asha Devi Vs. Chandrika Prasad, under Section 34 of U.P. Revenue Code, 2006, expeditiously in accordance with law without granting any unnecessary adjournments subject to cooperation of the learned counsel for the parties. .
