Heard Shri Vijyant Nigam, learned counsel for the petitioners and Shri Satish Kumar Sharma, learned counsel for the opposite party.

By means of the instant writ petition filed under Article 227 of the Constitution of India, the petitioners have challenged the validity of an order dated 01.11.2023 passed by the learned Civil Judge (S.D.), Malihabad, Lucknow in Original Suit No.2214 of 2023, on the ground of lack of jurisdiction and concealment of material facts.

However, the learned counsel for the petitioners does not want to press the aforesaid prayer and he confines his prayer for issuance of a direction to the learned Civil Judge (S.D.), Malihabad, Lucknow for expeditious disposal of the petitioners' application under Order 39 Rule 4 CPC.

The aforesaid application has been filed by the petitioners' on 11.09.2024.

Learned counsel for the opposite party has no objection to the aforesaid limited prayer of the learned counsel for the petitioner.

Accordingly, the petition is disposed of by issuing a direction to the learned Civil Judge (S.D.), Malihabad, Lucknow to decide the petitioners' application under Order 39 Rule 4 CPC pending in Original Suit No.2214 of 2023 expeditiously, after giving adequate opportunity of hearing to the parties.
