The present petition has been preferred to direct the Principal Judge, Family Court/ Judge Family Court-5, Lucknow to hear and decide the suit no. 2240 of 2024 (Sunni Rai Vs. Nisha Rai) filed under Section 9 of the Hindu Marriage Act, 1955, after preponing the date fixed i.e. 15.10.2024.
Learned counsel for the petitioner submitted that a matrimonial dispute is pending between the parties.
The petitioner has directly approached this Court within one month of filing of the suit, which is too early to approach this Court for issuance of direction to the Principal Judge, Family Court/Judge Family Court-5, Lucknow to conclude the proceeding within the stipulated time as prayed in the present petition.
At this stage, learned counsel for the petitioner prayed that the petitioner may be permitted to withdraw the present writ petition is dismissed as not pressed at this stage .
