Yesterday, a request had been made by learned counsel for the petitioner seeking permission for taking up the matter for today as it involved an urgency as the authorities were bent upon measuring the land which would adversely impact the rights of the petitioner.

Considering the same, the Court had permitted the matter to be taken up tomorrow (i.e. for today). It is in this context that the matter has been placed before the Court.

At the outset, Sri Hemant Pandey learned Standing counsel for the State submits that in the instant petition challenge has been made to a notice dated 02.08.2024 which is Annexure-1 to the petition and in this context State authority, S.D.M Mohanlalganj Lucknow by its order dated 06.08.2024 has withdrawn the said notice keeping in view that a similar issue is already engaging the attention of this Court in Writ C no.2922 of 2024 (Raja Kumar vs State of U.P. and another).

In view of the above, since the order has been withdrawn, accordingly, no cause of action survives per se in this petition which is, accordingly, dismissed.
