Shri Ashutosh Bajpai, learned counsel for the respondent no. 2 has put in appearance and has submitted that the present petition has been filed for setting aside the order dated 11.06.2024 passed by the Civil Judge (Senior Division), District Bahraich in General Misc. Case No. 103/70/24 (Patan Vs. Radheshyam) whereby the application no. C-3 preferred by the petitioner alongwith the suit for taking up the suit during the summer vacation in the month of June was rejected. Now the Courts are regularly functioning after the vacations, hence this petition has lost its efficacy for the reason, the prayer sought in the present petition has become infructuous.
In view of the aforesaid, the present petition is dismissed as infructuous.
