Heard learned counsel for the applicant, Sri Vivek Kumar Rai, learned counsel for the informant as well as learned A.G.A. and perused the record.

2 . It is argued by the counsel for the applicant that the co-accused were enlarged on bail vide orders dated 30.01.2024 and 22.03.2024, as such, the applicant may also be enlarged on bail on the ground of parity. It is further argued that the applicant is the husband and is in custody since 25.09.2023 and only one witness has been examined so far.

3. Learned A.G.A. as well as the learned counsel for the informant opposed the bail prayer.

Considering the allegations against the applicant to be similar to the co-accused, who have been enlarged on bail coupled with the fact that only one witness has been examined so far, as such, there is no likelihood of the trial being concluded in near future and the applicant has suffered pre trial detention of more than one year, the applicant who has no criminal history is enlarged on bail. Accordingly, the bail application is allowed .

5. Let the applicant Ajayjeet @ Sanju Shukla be released on bail in FIR/ Case Crime No. 651 of

2023, under Sections 498-A, 304-B IPC and Section 3/4 D.P. Act, Police Station Thakurganj, District Lucknow, on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.
