Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.

Upon request made by learned counsel for the petitioner, he is permitted to implead the Chief Treasury Officer, Treasury Office, Amethi in the array of respondents during the course of the day. Learned Standing Counsel has accepted the notice.

Present petition has been preferred for issuing a direction to the respondents to release the family pension to the petitioner for which she is entitled after demise of her husband on 15.05.2016.

On the other hand, learned Standing Counsel on the basis of instructions received has stated that on 28.08.2023, the respondent no. 5 has forwarded the papers of the petitioner to the Chief Treasury Officer, Amethi-respondent no. 9 and till date no order has been passed thereon.

After arguing at some length, learned counsel for the petitioner has confined his prayer to the extent that respondent no. 5-Chief Medical Officer, Amethi and respondent no. 9-Chief Treasury Officer, Treasury Office, Amethi may be directed to take a decision on the representation of the petitioner dated 27.07.2023 as early as possible.

Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioner for taking a decision on claim/representation of the petitioner for payment of family pension.

On the request of learned counsel for the petitioner and without entering into the merit of the case, present writ petition is disposed of with a direction to the respondent nos. 5 and 9 to consider and decide the claim of petitioner for grant of family

pension within a period of two months from the date of production of certified copy of this order.
