Present writ petition has been preferred for issuance of a direction in the nature of mandamus to opposite parties to consider the claim of the petitioner for compassionate appointment under Dying in Harness Rules after the demise of husband of the petitioner on 29.04.2023.
Learned counsel for the petitioner has submitted that the husband of the petitioner late Aman Kumar was posted as Constable in P.A.C. and he had expired on 29.04.2023, thereafter, petitioner made a representation on 15.05.2023 to consider her candidature for compassionate appointment under Dying In Harness Rules but till date no decision has been taken.
After arguing at some length, learned counsel for the petitioner has confined his prayer to the extent that respondent no. 3- Commandant of 10th Battalion P.A.C., Barabanki may be directed to consider and decide the representation of the petitioner mentioned hereinabove within the time as this Hon'ble Court may deem fit and proper.
Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioner.
On the request of learned counsel for the petitioner and without entering into the merit of the case, the writ petition is disposed of with a direction to the respondent no. 3 to consider and decide the representation of the petitioner dated 15.05.2023 within a period of two months from the date of production of certified copy of this order.
