Heard learned counsel for the applicant and learned A.G.A. for the State as well as Ms. Shivani Rajpoot, Advocate who has filed his vakalatnama on behalf of opposite party no.2, which is taken on record.

The present application u/s 482 Cr.P.C has been filed with prayer to quash the impugned charge sheet dated 01 dated 11.03.2023 in Case Crime/ F.I.R. No.13 of 2023, under Section 323, 504, 506, 308 IPC, Police Station Safipur, District Unnao and also quash the order dated 20.12.2023 passed by the Judicial Magistrate, Unnao and also quash the entire proceedings of Criminal Case No.1880 of 2023 (State vs. Munshi Lal and Others) pending before the Judicial Magistrate, Unnao, on the basis of compromise between the parties.

Contention of the learned counsel for the applicants is the both the parties have amicably settled their dispute which is reduced in writing as compromise deed dated 26.09.2023. The copy of the same is annexed as Annexure No.4 to the present application.

This fact is not disputed by learned counsel for the opposite party no.2 as well as learned A.G.A. for the State.

Considering the aforesaid submission, the applicants are directed to file the aforesaid original compromise deed for verification before the trial court, within a period of two weeks from today.

On filing the aforesaid compromise deed, the trial court shall verify the same after summoning the parties, within a period of two months.

The parties are at liberty to file a fresh petition for quashing of the impugned proceedings of the aforesaid case on the basis of certified copy of verified compromise deed.

For a period of two months, no coercive action shall be taken against the applicant in Criminal Case No.1880 of 2023 (State vs. Munshi Lal and Others) pending before the Judicial Magistrate, Unnao, arising out of Case Crime/ F.I.R. No.13 of 2023, under Section 323, 504, 506, 308 IPC, Police Station Safipur, District Unnao.

Office is directed to return the original copy of compromise deed to the learned counsel for the applicants after retaining the photocopy of the same.

With the aforesaid direction, the present application is disposed of.
