1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

2 . The applicant seeks enlargement on bail in FIR No.127 of 2024, under Sections 19(2), 115(2), 352, 103(1) BNS, Police Station Sohramau, District Unnao.

In terms of the FIR, it was alleged that on 02.07.2024, the wife of the informant was standing behind the door when all the accused came and started beating her and when the brother of the informant tried to intervene, he was also beaten up. Subsequently, the wife of the informant died. The postmortem report indicates the presence of as many as four injuries, which are lacerated and swelling. The cause of death is due to ante mortem injuries.

4 . Learned A.G.A. vehemently opposed the bail prayer.

Considering the fact that the general allegations were levelled against all the accused including the applicant, who is a lady and there being nothing specific agaisnt her and no recovery was also effected from the applicant coupled with the fact that the applicant is in custody since 02.07.2024 and has no criminal history, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed .

6. Let the applicant Raj Kumari @ Ram Kumari be released on bail in the aforesaid first information report on her furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶13

(b) The applicant shall not commit any offence similar to the offence of which she is accused or suspected of the commission; and

¶14

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
