On an objection raised by Shri Atul Kumar Mishra, learned State Counsel that the petitioner has statutory and alternative remedy of appeal, which was earlier availed by the petitioner also, Shri Sharad Pathak, learned counsel for the petitioner submits that the petition may be dismissed as not pressed with liberty to avail the remedy of appeal. To which there is no objection by learned State Counsel.
In view of above, the writ petition is dismissed as not pressed with the liberty as aforesaid.
