Heard learned counsel for petitioners, learned counsel for opposite party no.1, Ms. Shruti Sahu, learned counsel for opposite parties no. 2 & 3 and Mr. Pankaj Patel, learned counsel for opposite party no.4.

Petition has been filed seeking a direction to opposite parties for payment of leave encasement due to petitioners alongwith interest in view of the fact that petitioner no.1 superannuated in the year 2019 and petitioner no.2 superannuated in the year 2020.

Considering innocuous prayer being made by learned counsel for petitioners, without entering into the merits of the case and particularly since adjudication of petitioners' grievance would entail factual aspects, liberty is granted to petitioners to file fresh individual representation before opposite party No.3 i.e. Managing Director, Pradeshik Cooperative Dairy Federation Limited, Lucknow which shall be considered and decided in the light of judgment rendered by Coordinate Bench of this Court in the case of Ata Husain Rizvi versus State of U.P. & Ors. Writ A No.7243 of 2023 in case the same is applicable within a period of eight weeks from the date a certified copy of this order is produced before the said authority.

In case petitioners are found entitled for the said relief, actual payment thereof shall be ensured within a period of six weeks thereafter. The concerned authority shall also consider the aspect of payment of interest on delay within the same time period.

With aforesaid directions, petition stands disposed of .
