The present appeal has been filed under Section 14-A (2) of Scheduled Castes and Scheduled Tribes Act, 1989 against the impugned order dated 09.11.2021 passed by Special Judge, SC/ST Act, District- Bahraich in Misc. Criminal Case No. 461/12/2021 under Section 156(3) Cr.P.C., Police Station- Kotwali Nanpara, District- Bahraich. Relevant portion of the order dated 09.11.2021 is quoted here-in-under:

उपरकोक वविधधिक ससरवत कने पकቚኋशि मम अवभिलनेख कने अविलकोकन सने पगट हकोतቚኋ हमै वक आविनेदक दቚኋरቚኋ यह आकनेप लगቚኋयቚኋ गयቚኋ वक वविपकलीगण कቚኋ बतख पቚኋरቕኍ कने घर मम घुቚኋ। पቚኋरቕኍ वि उसककी भि स ह को कलቚኋवितली नने बतख कको अपनने घर सने भिगቚኋ वदयቚኋ तरቚኋ वविपकलीगण सने कहቚኋ वक अपनቚኋ बतख अपनने घर ककी तरफ लने जቚኋओ इसली पर वविपकलीगण नቚኋरቚኋज हको गयने। वविपकलीगण लቚኋठली डण्डने सने लमैस हकोकर पቚኋरቕኍ कने घर मम घुकर पቚኋरቕኍ वि उसककी बहह कको लቚኋत स , मपूकቚኋ सने मቚኋरनने पलीटनने लगने वि जቚኋवत सपूचक भिदली - भिदली गቚኋधलयቚኋसं दली।

परन्तसु पतቚኋविलली पर रቚኋनने पर सपूचनቚኋ वदयने जቚኋनने कने सम्बन्धि मम ककोई पपत नहीሻ दቚኋधखल वकयቚኋ गयቚኋ हमै। वदनቚኋसंक ०१ . ०९ . २०२१ कको मቚኋरनने पलीटनने कቚኋ करन वकयቚኋ गयቚኋ हमै तरቚኋ आघቚኋत आख्यቚኋ वदनቚኋसंक ०४ . ०९ . २०२१ कቚኋ हमै इन तलीन वदनोሪ कने मध्य ककोई डቚኋक्टर कቚኋ पचቚኋर अरविቚኋ दविቚኋ इलቚኋज कቚኋ पचቚኋर नहीሻ पसतसुत वकयቚኋ गयቚኋ हमै। रቚኋनने पर सपूचनቚኋ वदयने जቚኋनने कने सम्बन्धि मम ककोई पपत पतቚኋविलली पर दቚኋधखल नहीሻ वकयቚኋ गयቚኋ हमै , धजससने सप्ቖ हमै वक आविनेदक धिቚኋरቚኋ १५४ ( १ ) द०प०ससं० कने अजቚኋपक पቚኋवविधिቚኋनोሪ कቚኋ अनसुपቚኋलन नहीሻ वकयቚኋ गयቚኋ हमै। मቚኋननलीय ' उच्चतम न्यቚኋयቚኋलय दቚኋरቚኋ शलीमतली वपयቚኋसंकቚኋ शलीविቚኋसतवि बनቚኋम उ्ቈर पदनेशि रቚኋज्य ए . आई . आर . २०१५ ससुपलीम ककोटर १७५८ कने मቚኋमलने मम पवतपቚኋवदत धसቍኌቚኋन्त कने आधिቚኋर पर धिቚኋरቚኋ १५४ ( १ ) द०प०ससं० कቚኋ अनसुपቚኋलन न हकोनने कने कቚኋरण आविनेदन पकोषणलीय नहीሻ हमै। आविनेदन सቚኋरहलीन हकोनने एविसं पकोषणलीय न हकोनने कने कቚኋरण खቚኋररज वकयने जቚኋनने यकोग्य हमै।

Brief facts of the case are to the effect that an application filed under Section 156(3) Cr.P.C. was preferred by the appellant, which is on record, and a perusal thereof indicated that on account of some dispute related to ducks, the respondent no.2 entered in the house of the appellant at 07:00 on 01.09.2021 and there some altercation/ hot talks took place between them and in this incident, the appellant sustained injuries and in relation to the same, the appellant was examined on 04.09.2021.

The Trial Court, after considering the contents of the application as also the material evidence on record and also the relevant law/ proposition settled in the judgment(s) passed in the case of Sukhwasi Vs. State of Uttar Pradesh 2007 (59) SCC 939 ; Maksood Vs. State of Gujarat (2008) 5, SCC 668 and Smt. Priyanka Srivastava Vs. State of Uttar Pradesh AIR 2015 SCC 1758 and rejected the application filed under Section 156(3) Cr.P.C.

Impeaching the order, under appeal, dated 09.11.2021, the counsel for the appellant stated that in view of the specific allegation levelled in the application under Section 156(3) Cr.P.C. as also the evidence in support thereof submitted

by the appellant, the Trial Court ought to have allowed the application filed under Section 156(3) Cr.P.C. and as such indulgence of this Court is required. 6. Learned A.G.A. for the State as well as the counsel for the respondent no.2 stated that in view of the law settled on the issue on dealing with the application under Section 156(3) Cr.P.C., as also taking note of the allegation levelled in the application filed under Section 156(3) Cr.P.C., it is apparent that in the facts of the case, investigation is not required and accordingly, no interference is required in the impugned order and the appellant, if aggrieved, can institute a complaint case.

Considered the facts of the case and perused the record, including the impugned order.

From a perusal of impugned order dated 09.11.2021, it is evident that one of the reasons for rejecting the application filed under Section 156(3) Cr.P.C. is to the effect that prior application filed under Section 154(1) Cr.P.C. was not placed before the Magistrate concerned, which was required as per observations made by the Hon'ble Apex Court in the case of Priyanka Srivastava vs. State of Uttar Pradesh AIR (2015) SCC 1758, and to establish/prove the fact that the said application was on record, the certified copy of the same has not been placed on record before this Court. Thus, this Court finds no force in this appeal. It is accordingly dismissed.
