Heard learned counsel for the appellant, learned AGA for the State and perused the record.

By means of instant appeal under Section 14-A(i) of Scheduled Cases and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short "SC/ST Act"), the appellant has assailed the order dated 23.01.2024 passed by Special Judge S.C./S.T. (P.A.) Act, Hardoi in Misc. Case No. 857 of 2023, under Section 156(3) Cr.P.C., Police Station- Pihani, District- Hardoi.

By the order impugned dated 23.01.2024, the application of the appellant has been rejected. Relevant portion of the order dated 23.01.2024 on reproduction reads as under:-

Impeaching the order under appeal dated 23.01.2024, learned counsel for the appellant says that in dismissing the application preferred by the appellant under Section 156(3) Cr.P.C., the trial court committed error of fact and law both. As such, indulgence of this Court is required in the matter.

Opposing the present appeal, learned AGA says that the impugned order dated 23.01.2024 is not liable to be interfered with by this Court for the reason(s) that the case setup by the appellant in the application preferred under Section 156(3) Cr.P.C. was completely vague.

Considered the aforesaid and perused the record.

Upon due consideration of the aforesaid including the fact(s), which appears from the record, that (i) the allegations of committing rape have been levelled by the appellant in the application preferred by her under Section 156(3) Cr.P.C. against son (Saurabh s/o Devendra Singh) and father (Devendra Singh), which appears to be improbable, and some others (ii) prior to filing of application under Section 156(3) Cr.P.C., the appellant lodged one FIR on 09.10.2023 alleging therein that Saurabh s/o Devendra Singh and Devendra Singh (son and father) committed rape with her on 22.04.2023 and (iii) prior to FIR dated 09.10.2023, a missing report was lodged and in this regard, the statements of

appellant and her father were recorded by the police officer and according to the same, the appellant on her own left her house, this Court finds that the trial court has rightly rejected the application of the appellant and there is no illegality in the order impugned dated 23.01.2024. The appeal is accordingly dismissed .
