Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

Learned counsel for the applicant argued that the applicant was on bail vide order dated 27.10.2020 passed by the learned trial court. However, as the applicant could not appear on one date, as such non bailable warrant was issued and the applicant has been detained in custody since 16.12.2023. The applicant ready to undertake that he will appear on each and every date before the concerned trial court and cooperate with the trial. Hence, the applicant who is in custody since 16.12.2023 having no criminal history, may be enlarged on bail.

Learned A.G.A. opposed the prayer for bail.

Considering the aforesaid undertaking couple with the fact that the applicant who is languishing in jail since 16.12.2023 having no criminal history , I am of the view that the applicant is entitled to bail.

Accordingly, the bail application is allowed.

Let the applicant Sameer Qureshi be released on bail in FIR/ Case Crime No.326 of 2019, under Sections 307/34 I.P.C., Police Station Hasanganj, District Unnao on his furnishing personal bonds and two fresh reliable sureties of Rs.25,000/- each to the satisfaction of the court concerned with the following conditions :-

(a) The applicant shall furnish an undertaking

before the trial court to cooperate with the trial ; (b) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(c) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶15

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.
