Heard learned counsel for the petitioner and Sri Dipak Seth, learned counsel for Respondent Nos.1 to 3 and perused the record.

The present writ petition has been preferred for quashing of the impugned chargesheet dated 20.12.2023 and with further prayer to direct the respondents to relieve the petitioner who is working on the post of Divisional Accountant (Probationer), Prayagraj as the petitioner has tendered his resignation (NonTechnical) on 19.07.2023.

Shri Deepak Seth, learned counsel for Respondent Nos.1 to 3 has submitted that the charge-sheet against the petitioner has been withdrawn vide order dated 8.1.2024 and for relieving by accepting the resignation of the petitioner, it depends on the No Objection Certificate issued by the Executive Engineer, Irrigation Division, Sultanpur - Respondent No.4 where the petitioner after selection had been posted.

Learned counsel for the petitioner has submitted that 13.01.2024 is the last date of joining of the petitioner in the Income Tax Department on the post of Income Tax Inspector and requested that some direction may be issued to the Respondent No.4 to issue No Objection Certificate as early as possible, so that he may be relieved as per statement of the learned counsel for Respondent No.2.

After hearing learned counsel for the parties and going through the record, the Respondent No.4 is directed to consider for issuance of No Objection Certificate in favour of petitioner within a period of three days from the date certified copy of this order is served and it is expected that the Respondent No.2, if received the NOC issued by Respondent No.4, shall immediately relieve the petitioner as per the statement given by

the learned counsel for Respondent No.2 before this Court. With this observation, the writ petition is finally disposed of.
