Heard learned counsel for the petitioner as well as learned Chief Standing Counsel for the State-respondents.
By means of the instant petition, the petitioners sought the quashing of the proceedings of Case No. D202408300000523 U/s 198 (4) of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950.
During the pendency of the instant petition, the instructions were called upon and thereafter the State has filed a short counter affidavit wherein it has been stated that due to certain technical defects, the State is not willing to proceed with the matter and shall withdraw the same. The affidavit has been filed by the Collector dated 10.07.2024 is taken on record.
The learned Additional Chief Standing Counsel has also provided a copy of the order dated 11.07.2024 passed in the said proceedings whereby the proceedings have been withdrawn.
In view thereof, nothing survives in the present petition which is accordingly dismissed .
It is made clear that the dismissal of the present petition shall not come in the way of the State in case if any proceedings are required to be initiated on the basis of the material which may come to the notice, and as per law.
