Heard learned counsel for the petitioner, Mr Gopal Kumar Srivastava, learned counsel for opposite party nos.1,2 and 3 and learned Standing Counsel for opposite party no.4.

Petition has been filed seeking a direction to the opposite parties to permit petitioner to join at the Branch concerned in District Mahoba. Further prayer for constitution of medical board in terms of communication dated 23.04.2024 and for considering transfer of petitioner to an urban branch has also been sought along with relief for grant of pay and another benefits from 23.04.2024.

This Court vide order dated 14.06.2024 has recorded submissions of learned counsel for parties particularly to the effect that petitioner was earlier transferred on 20.06.2022 but did not join at the transferred place on account of ill health whereafter he submitted his joining after about two years due to which a medical board was required to be constituted. The order also indicates that a charge sheet in the meantime has been issued to the petitioner initiating disciplinary proceedings against him for absconding from duty.

In pursuance of directions issued earlier, learned counsel for parties submit that a medical board was thereafter constituted which has already submitted its recommendation finding the petitioner healthy enough to join his duty.

Mr Gopal Kumar Srivastava, learned counsel appearing for Bank, on the basis of instructions, however, submits that the recommendation of medical board has already been sent to the corporate office which is now required to pass appropriate orders thereupon as per rules.

In view of aforesaid submissions of learned counsel for parties and particularly since medical board has already submitted its recommendation, the competent authority is directed to take final decision in accordance with law with regard to petitioner's joining within a period of three weeks from the date a certified copy of this order is produced before it.

In the aforesaid directions, the petition stands disposed of.
