Heard learned Counsel for the applicant as well as learned A.G.A. and perused the record.

Submission of Counsel for the applicant is that the basis for invoking the provisions of Gangsters Act against the applicant is the sole case which has been shown in the gang chart and in the said case, the applicant is on bail. The applicant is also on bail in other five cases details of which have been mentioned in paragraph 9 of the bail application as well as in the rejoinder afÏdavit. Hence, the applicant who is in custody since 16.3.2023, may be released on bail.

Per contra, learned A.G.A. has opposed the bail prayer of the applicant.

Considering the submissions made by learned counsel for the parties and and keeping in view the fact that the applicant has already been enlarged on bail in the sole case shown in the gang chart as well as in other cases which are not shown in the gang chart, I am of view that the applicant is entitled for bail.

Accordingly, the present application is allowed.

Let the applicant Vikas Yadav be released on bail in Case Crime/ FIR No.333 of 2023, under Section 3(1) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 registered at Police Station Chhapia, District Gonda on his furnishing a personal bond with two sureties of the

like amount each to the satisfaction of court concerned with the following conditions: -

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer or tamper with the evidence.
