Heard learned counsel for the petitioner and Sri Pankaj Srivastava, the learned Additional Chief Standing Counsel.

By means of instant petition filed under Article 226 of the Constitution of India, the petitioner has prayed for issuance of a writ commanding the opposite parties to conduct an enquiry against opposite parties nos. 4 and 5 (Secretary of Gram Sabha and Gram Pradhan), which is pending since 07.12.2023.

On the basis of written instructions provided by District Panchayat Raj, Amethi, the learned Additional Chief Standing Counsel has informed the Court that a preliminary enquiry has already been conducted by the Assistant Labour Commissioner, Amethi who has submitted his report on 19.09.2023. Thereafter a show cause notice was issued to the opposite party no. 5 on 06.10.2023.

The opposite party no. 5 has given reply to the the show cause notice, which was not found to be satisfactory and by means of an order dated 07.12.2023, the financial and administrative powers of opposite party no. 5 have been seized. Thereafter, a final enquiry was conducted and a final enquiry report has been submitted on 14.03.2024. It has been stated that in the instructions, provided to the learned Additional Chief Standing Counsel, that further action will be taken soon after completion of ongoing Parliament Elections.

Accordingly, the writ petition is disposed of with a direction to the opposite party no. 3-District Magistrate, Amethi to ensure appropriate action against opposite party no. 5 in furtherance of the findings of the final report dated 14.03.2024 expeditiously, in accordance with law.
