Heard learned counsel for the petitioner. Notice on behalf of respondent nos. 1 and 2 has been accepted by the office of the Chief Standing Counsel.
Dr. Krishna Singh, learned Standing Counsel for the State submits that the petitioner has not impleaded the appropriate parties who were parties before the Consolidation Officer.
He further submits that the orders passed by the Consolidation Officer relating to the year 2019 has been assailed in the instant petition and no proper latches have been explained.
It has also been submitted that against the impugned orders, the petitioner has a statutory remedy available under the Uttar Pradesh Consolidation of Holdings Act, 1953 and for the aforesaid reasons, the petition may not be entertained.
The learned counsel for the petitioner at this stage submits that she does not wish to press the instant petition, however, she seeks liberty to file appropriate proceedings before the appropriate statutory forum.
In light of the statement so made by learned counsel for the petitioner, the petition is dismissed as withdrawn with liberty to the petitioner to approach the statutory forum.
