The present contempt application (civil) has been preferred for alleged wilful disobedience of the judgment and order dated 16.05.2022 passed in Writ A No. 2753 of 2014.
It is an admitted case of the applicant that for the first time cause of action arose in the month of September, 2022 and the present contempt application has been filed after the expiry of more than two years, which is barred by limitation as provided under Section 20 of the Contempt of Courts Act, 1971.
At this stage, learned counsel for the applicant has submitted that the applicant may be permitted to withdraw the present case as dismissed as not pressed with liberty to move an appropriate application for modification of judgment and order dated 16.05.2022 passed in Writ A No. 2753 of 2014.
As prayed, the present case is dismissed as not pressed.
The applicant is always at liberty to avail the remedy, as may be permissible under the law.
