Learned counsel for the applicant has submitted that only one case has been shown in the Gang Chart in which the applicant has been granted bail by means of the order dated 15.02.2024 passed in Criminal Misc. Bail Application No.2960 of 2023; Tipu Sultan Alias Rashid Versus State of U.P. in case Crime No.188 of 2020 under Sections 147, 148, 149, 302, 120-B, 34 IPC, 7 Criminal Law Amendment Act, P.S. Gangaghat, DistrictUnnao. He further submits that on account of the aforesaid involvement one another case Crime No.195 of 2020, under Section 3/25 Arms Act, Police Station-Gangaghat, DistrictUnnao has been registered against the applicant, in which also the applicant has been enlarged on bail by means of the order dated 21.03.2024 passed in Bail Application No.627 of 2024; Tipu Sultan @ Rashid Versus State of U.P. by the Additional Sessions Judge, Court No.3, Unnao. The copies of the aforesaid bail orders have been placed on record as annexure no.3 and 4 to the bail application. He further submits that at least seven co-accused have already been enlarged on bail. It has also been submitted that the applicant is not involved in any antisocial activities and he has been falsely implicated. The applicant is in jail since 29.06.2020. It has also been submitted that there is no possibility of the applicant's fleeing away from the judicial process or tampering with the witnesses. Learned counsel further submits that in case the applicant is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
