The present contempt application is filed with the prayer to issue the notice to the opposite party for non-complaince of the order dated 30.7.2024 passed in Writ A No.5892 of 2024 'Head Constable (Civil Police) Jitendra Kumar & Ors. Vs. State of U.P. & Ors.'.

Learned counsel for the applicant submits that representation of the applicants was decided by the respondent authority vide order dated 29.8.2024 without considering prayer as well as facts mentioned in the representation, therefore, respondent may be summoned and punished accordingly.

It is evident from the order passed by the writ court that respondent authority was directed to take decision on the representation of the applicants by a reasoned & speaking order. As it is undisputed fact that representation of the applicants has been decided, and it is well settled by this Court as well as Hon'ble Supreme Court that merits of the decision of the competent authority cannot be examined in the contempt jurisdiction. In such circumstances, the present contempt application is misconceived and same is hereby, dismissed .
