Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite party no.1 and Mr. Savitra Vardhan Singh, learned counsel appearing for opposite party no.2.

Petition has been filed seeking a direction to opposite party not to finalize selection process pursuant to advertisement dated 05.09.2023. Further prayer for a direction to opposite party to place or produce audio video recording of the interview hold on 23.12.2023 has also been sought.

Learned counsel for opposite party no.2 at the very out set has raised a preliminary objection regarding maintainability of this petition in view of the fact that petitioner has already approached the Chancellor vide letter dated 08.01.2024 seeking the same relief and therefore until and unless the same is decided, the present petition is not maintainable. He has also raised an objection that even otherwise relief sought in the petition have become infructuous in view of the fact that selection process has already been finalized with issuance of select list and subsequent appointment letter on 26.12.2023.

However looking to fact that petitioner has already approached before Hon'ble Chancellor with regard to his grievance, it would not be appropriate to entertain this petition at this stage which is accordingly disposed of granting liberty to petitioner to pursue his application before the Hon'ble Chancellor.
