Heard learned counsel for the petitioner, learned Standing Counsel for the respondents no. 1 to 3 and Shri Utsav Mishra learned counsel for the respondents no. 4 and 5.

The instant writ petition has been filed with respect to selection conducted on the post of Revenue Lekhpal vide advertisement no. 1 of 2022 contending that the petitioner has not been given benefit of reservation of physically handicapped category of which he is entitled.

A preliminary objection has been taken by Shri Utsav Mishra, learned counsel appearing for the respondents no. 4 and 5 that Hon'ble Apex Court is already seized of the matter in SLP (C) No. 25828 of 2023 in re: Shri Dhar Yadav and others vs State of UP and others and Hon'ble Supreme Court vide the order dated 19.02.2024 passed in Misc Application No. 276 of 2024 in the aforesaid SLP has categorically directed in paragraph 5(III) that any petition filed after 21.11.2023 questioning any of the answer keys of the any of the booklet series or any other issue related to the subject examination shall not entertained by the High Court.

The argument of Shri Utsav Mishra is that once Hon'ble Supreme Court is already seized of the matter and has restrained the High Court to entertain any petition after 21.11.2023 on any issue related to subject examination, the reservations of the physically handicapped category as is being claimed by the petitioner in the instant writ petition would also

fall within the ambit of being "any other issue related to the subject examination" consequently this Court may not entertain the writ petition.

Learned counsel for the petitioner does not dispute the aforesaid directions as have been issued by Hon'ble Apex Court vide order dated 19.02.2024 passed in SLP (C) No. 25828 of 2023 whereby Hon'ble Supreme Court has required that no petition after 21.11.2023 on any issue related to the subjection examination would be entertained by this Court.

Considering the aforesaid and the direction of Hon'ble Supreme Court, the writ petition is dismissed leaving it open to the petitioner to pursue other remedies that may be available to him under law.
