Heard learned counsel for petitioner, learned State Counsel for opposite parties 1 to 4 and Mr. Tushar Gupta Advocate holding brief on behalf of Mr. Pankaj Gupta learned counsel for opposite party No.5.
Learned State Counsel at the very outset has raised preliminary objection regarding maintainability of this petition in view of the fact that allotment of fair price shop has been made in favour of Adarsh Mahila Swayam Sahayata Samooh, which in turn has choosen the petitioner for functioning of the fair price shop since she is a member of the aforesaid 'Samooh' but the same group has not been impleaded as a petitioner in the petition which is not maintainable solely at the behest of petitioner.
On such an objection being raised, learned counsel for petitioner on the basis of instructions seeks to withdraw this writ petition with liberty to file afresh with impleadment of the group as a whole along with petitioner.
In view of aforesaid, the petition is dismissed as withdrawn granting the aforesaid liberty.
